Elon Musk says his fight with OpenAI isn't about money. In an X post, he pledged that any proceeds from his 2024 lawsuit against OpenAI and Microsoft will be donated—no personal gain. The suit alleges the companies abandoned OpenAI's original nonprofit mission for profit, with Musk pointing fingers at Sam Altman and Microsoft. Musk, an early co-founder who invested ~$38M before leaving in 2018, now leads xAI.

A March 13 pretrial ruling kept alive a damages report from Berkeley Research Group economist C. Paul Wazzan, who estimated OpenAI could owe up to $109 billion if found in breach. Microsoft could face $25 billion, though that part hasn't been greenlit yet. The judge barred punitive damages and warned that even a win could mean far less—statutes of limitations and partial credit for OpenAI's success could shrink the payout.

Trial starts April 28. OpenAI and Microsoft deny everything.
